The petitioners are apprehending their arrest in connection with Nagar P.S. Case No. 43 of 2014 for the offences instituted under Sections 420, 467, 468, 406, 354 and 504/34 of the IPC.

The prosecution story, in brief, is that the petitioners and co-accused Bikrama Bhagat sold a plot of land to the informant for an amount of Rs. 6,10,000/- on 27.12.2012. The informant repeatedly requested for demarcation of the said land to them but did not demarcate the land. She sent a legal notice on 24.12.2013. When she approached them for demarcation of land, she was

Patna High Court Cr.Misc. No.51864 of 2016 (2) dt.07-12-2016 2/2 assaulted and disrobed by the petitioners and co-accused Ajay Singh who told her that they have again sold the same land and would not demarcate the same.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. They have falsely been implicated in the present case. The matter relates to sale and purchase of land. There is a title suit also pending in the court below. The matter relates to civil dispute. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Nagar P.S. Case No. 43/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
