The petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 137/2017 dated 16.02.2017 instituted for the offences under Sections 448, 307, 384, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the F.I.R. It has been alleged in the F.I.R. that three persons came to the shop of the informant and two of them started firing from their weapons. The firing was resorted to for the reason that the informant had not paid up Rs. 5 lakhs, which was demanded by the accused persons. Learned counsel for the petitioner has submitted that the petitioner has been remanded in this case from Saharsa Sadar P.S. Case No. 173/2017, in which he has been granted bail. After his

Patna High Court Cr.Misc. No.55796 of 2017 (3) dt.22-12-2017 2/2 remand in the present case, he is said to have made a selfincriminating statement regarding his participation in the occurrence. Apart from this, there is no other material against the petitioner.

The petitioner is in custody since 29.05.2017. Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 137/2017.
