JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Session Trial No. 16 of 2017, arising out of Kathaiya P.S. Case No. 22 of 2013, registered under Sections 147, 148, 149, 341, 323, 324, 379, 302 and 120(B) of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the prayer for bail of the petitioner was refused thrice lastly on 03.07.2019 vide Criminal Miscellaneous No. 26532 of 2019 with observation that petitioner may renew his prayer for bail after one year. Further submission is that after passing of aforesaid order dated 03.07.2019, by which the prayer for bail of the petitioner was rejected, more than one year has already been elapsed. The petitioner is in custody since 02.04.2016.

No.4964 of 2021(3) dt.07-04-2021 2/2 Having regard to the facts and the circumstances of the case and also keeping in view the observation given to the petitioner vide order dated 03.07.2019 passed in Criminal Miscellaneous No. 26532 of 2019, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Muzaffarpur in connection with Session Trial No. 16 of 2017, arising out of Kathaiya P.S. Case No. 22 of 2013.
