JUSTICE SUDHIR SINGH ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 272 and 273 of the Indian Penal Code and Section 47(A) of the Excise Act.
Allegation against petitioner is that from his possession 47 litres Mahua wine has been recovered.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 47 litres of Mahua wine is said to have been recovered from possession of petitioner. No compliance under section 100 of the Code of Criminal Procedure is made.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with
Patna High Court Cr.Misc. No.51244 of 2016 (2) dt.02-12-2016 2/2 two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sherghati, Gaya, in connection with Maigra P.S.
