2. The petitioner seeks bail in connection with Misc. Excise Case No. 2765 of 2023 arising out of Excise Simrahi Supaul P.S. Case No. 14 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Recovery is of 261 litres of illicit liquor.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 23.03.2024 and he has one criminal antecedent.

5. Considering the period of custody and the recovery of liquor, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on

Patna High Court CR. MISC. No. 47762 of 2024(2) dt.10-07-2024 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Court No.2, Supaul in connection with Excise Case No. 2765 of 2023 arising out of Excise Simrahi Supaul P.S. Case No. 14 of 2023.

7. This is also subject to the condition that the petitioner will also deposit an amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) in Ramkrishna Math, Bhatta Bazar, Purnea, Bihar, 854301 and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.

8. The petitioner will visit Raghopur Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
