2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 149, 120B, 366A, 354 and 201 of the Indian Penal Code.

3. Petitioner is alleged to have abducted minor daughter of informant with the help of others, with the intention to marry her.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, informant's daughter is major, she is in love affair with the petitioner and both of them have married and present case is retaliatory action of the informant. Victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has denied the prosecution case. She has stated that she is in love with the petitioner and

Patna High Court CR. MISC. No.44202 of 2025(3) dt.08-09-2025 2/2 she left the house and performed marriage with the petitioner out of her free will. Presently, she is leading happy married life with him. Court has assessed her age to be 19 years at the time of recording of her statement.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering 164 Cr.P.C. statement of the victim, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Dhoraiya Police Station Case No. 405/2022, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
