This application is for grant of regular bail in connection with S.T.No.451 of 2017 arising out of Barauni P.S.Case No.193 of 2017 for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Allegation against the petitioner is of dowry death, who happens to husband.
Submission of the learned counsel for the petitioner is that the deceased has committed suicide and he had informed to the family members of the Maike of the deceased and thereafter the dead body was disposed but later on he has been falsely implicated in this case and after realizing their mistake, now they have settled the dispute outside the court. The petitioner is in
Patna High Court Cr.Misc. No.53127 of 2017 (2) dt.15-11-2017 2/2 custody for five months.
Heard learned A.P.P. also.
Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial of the petitioner and once the informant as well as family members of the deceased are examined in this case, the petitioner is at liberty to renew his prayer for bail, which will be considered by the learned trial court on the basis of materials available at that time. With the aforesaid observation, this application is disposed of.
