The petitioner is apprehending his arrest in connection with Banshi P.S. Case No. 13 of 2016 for the offences instituted under Sections 420 and 409/34 of the Indian Penal Code. The allegation against the petitioner is that being Panchayat Secretary, he did not make available the relevant files relating to appointments of Panchayat teachers in the said gram panchayat, which were made during the previous years. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The
Patna High Court Cr.Misc. No.42993 of 2016 (4) dt.15-12-2016 2/2 petitioner has already deposited the documents relating to the appointments of the panchayat teachers, which were handed over to him by his predecessor. The other co-accused has been granted bail vide Cr. Misc. No. 43346 of 2016.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner vide order dated 24.10.2016 is hereby confirmed.
