The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
It is alleged that during the Krishna Janamastmi fair, the son of the informant Bittu Kumar had some altercation with petitioner no. 3 Bittu Kumar Rai. When the informant went to tea stall in front of the house of petitioner no. 1 Ramsagar Rai, then he abused the informant. Thereafter, petitioner no. 2 Vijay Rai and petitioner no. 3 Bittu Kumar Rai assaulted with axe and iron rod. When the informant's son Bittu Kumar and
Patna High Court Cr.Misc. No.55807 of 2015 (2) dt.09-12-2015 Santosh Kumar came to rescue, they were also assaulted. The accused persons also assaulted the husband of the informant. The accused persons also snatched gold chain from the son of the informant.
It is submitted by the learned counsel for the petitioners that the injury of the informant has been found to be simple in nature. There is counter version of the occurrence. The petitioners' sides have also received injury.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakiya O.P.) P.S. Case No. 332 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
