07-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Ishakchak P.S. Case No. 49 of 2021 corresponding to N.D.P.S. Case No. 23 of 2021, registered for the offence under Sections 276, 419, 420 of the I.P.C., Sections 18(c), 27(b)(ii), 28, 28(A), 36(AC) of the Drugs & Cosmetics Act and Sections 8,20,21,22 of the NDPS Act. 284 bottles of cough syrup each containing 100 ml., 300 gms. of Ganja, cash of Rs. 2205/- and mobile phone have been recovered from the house of co-accused Gulab @ Badshah @ Imtiyaz and the petitioner was arrested on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. So far as recovery of alleged Ganja is concerned, it is less than small quantity. Petitioner has got clean antecedent and he is in

Patna High Court CR. MISC. No.55864 of 2021(2) dt.07-12-2021 2/2 custody since 06.04.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur / concerned court in connection with Ishakchak P.S.
