JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-04-2016 The petitioners being father, brother and brother's wife of the husband of the daughter of the informant are apprehending their arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
The prosecution case is of torture to the daughter of the informant for non-fulfilment of dowry demand and causing burn injuries. The informant being father of the victim stated that victim stated that all the accused persons including the petitioners caused burn injuries to the victim. It is submitted by learned counsel for the petitioners that thrust of accusation is against the husband of the victim who has been granted regular bail vide Cr. Misc. No. 56590 of 2015.
Patna High Court Cr.Misc. No.57915 of 2015 (4) dt.05-04-2016 P2/2 Learned A.P.P, after going through the case diary has submitted that victim has stated that petitioners also facilitated in causing burn injuries and the doctor has found several burn injuries on the person of the victim. In the circumstance, this Court is not inclined to grant privilege of anticipatory bail to the petitioners. Let learned Court below consider the prayer for regular bail of the petitioners, keeping in view of the fact that husband has been granted regular bail on conclusion of the investigation, if the petitioners surrender within a period of six weeks in connection with Sultanganj P.S. Case No. 177 of 2015, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur.
With the observations above, the application stands disposed off.
