The Petitioner apprehends his arrest in Marauna P.S. Case No.76 of 2014 instituted for the offence under Section(s) 304-B, 201, 120-B/34 Indian Penal Code.
It has been submitted on behalf of the petitioner that he is the nephew of the husband of the deceased. There is general and omnibus allegation against him. It has come during investigation that the deceased died in Delhi due to illness. From the written report, it appears that there is allegation that the daughter of the informant was married with one Gulab Chand Thakur and she was tortured in her Sasural for the demand of motorcycle, buffalo etc. and she became traceless
Patna High Court Cr.Misc. No.55659 of 2016 (3) dt.06-02-2017 2/2 after going to Delhi with her husband.
Learned APP has pointed out different paragraphs of the case diary in which there is only omnibus and general allegation against the petitioner.
In the facts and circumstances of the case, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Marauna P.S. Case No.76 of 2014, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-I, Supaul, subject to the conditions as laid down under Section 438(2) Cr.
