14-09-2016 Heard Sri Arun Kumar Rai, learned counsel for the petitioner and Smt. Reena Sinha, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Jalalpur P.S. Case No. 104 of 2016 registered for the offence under Sections 341, 323, 307 & 504 of the Indian Penal Code, has prayed for grant of bail in the event of arrest or surrender. It was submitted by learned counsel for the petitioner that in village politics, petitioner has falsely been implicated showing his involvement in a quarrel between son of the informant and son of the petitioner. He further submits that though Section 307 of the Indian Penal Code has been incorporated in the F.I.R., there is no such injury. Learned counsel for the petitioner submits that save and except Section 307 of the I.P.C., all other
Patna High Court Cr.Misc. No.38139 of 2016 (2) dt.14-09-2016 2/2 sections of the Indian Penal Code are bailable. Learned Addl. Public Prosecutor has opposed the prayer for grant of anticipatory bail.
After hearing learned counsel for the parties and considering the nature of accusation, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Satyendra Singh @ Satendra Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IXth, Saran at Chapra in connection with Jalalpur P.S. Case No. 104 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
