JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 Earlier prayer for bail of the petitioner was rejected vide order dated 03.03.2017 passed in Cr. Misc. No. 52042 of 2016 with direction to the court below to expedite the trial and try to conclude the same within a period of six months and the petitioner was given liberty to renew his prayer for bail if the trial is not concluded within the aforesaid period.
It has been submitted by learned counsel for the petitioner that six months period has already expired and uptil now trial has not been concluded and petitioner has been in custody since 01.05.2017.
It appears that a report was called from the court below from which it appears that the trial court has reported that there is likelihood of conclusion of trial within two months and has
Patna High Court Cr.Misc. No.59292 of 2017 (3) dt.10-01-2018 2/2 accordingly prayed for extension of two months period to conclude the trial. In such view of the matter, I am not inclined to release the petitioner on bail rather the trial Court is directed to concluded the trial within a period of two months from today.
