Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 287 of 2020 registered for the offence under Sections 147, 148, 149, 307, 323, 324, 338, 337, 341, 353, 379, 427, 504 of the Indian Penal Code, Section 3 and 4 of the Prevention of Damage to Public Property Act, 1984 alongwith under Sections 47, 30 (a), 41 (2) (1) of the Bihar Prohibition and Excise Act, 2016. The allegation against the petitioner is that he had attacked on the police party and there is recovery of 108 litres of illegal liquor also. Learned counsel for the petitioner has submitted that petitioner is not involved in this case and similarly situated accused has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 05.07.2021, passed in Cr. Misc. No. 25584 of 2021.
Patna High Court CR. MISC. No.52719 of 2021(2) dt.17-12-2021 2/2 Learned A.P.P submitted that now it has become common in villages that people come in a mob and assault the police personnel and they try to take away the criminals.
Considering the above, I am not inclined to grant anticipatory bail to the petitioner.
