JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected on merit by this Court vide order dated 27.04.2017 passed in Cr. Misc. No. 11755 of 2017.

However, the present application has been filed on the ground that petitioner has been in custody since 28.08.2014 and uptil now not a single witness has been examined in this case. It appears that in this case a report was called for from the court below, from which, it appears that charge has been framed against two accused persons and after framing of charge one of the accused became absent and due to that his bail bond was cancelled and the case is now fixed for his appearance. Heard both sides.

In view of the fact that earlier the prayer for bail of the

Patna High Court Cr.Misc. No.60832 of 2017 (3) dt.03-01-2018 2/2 petitioner was rejected on merit, I am not inclined to release the petitioner on bail, however, considering the fact that petitioner has been in custody since long, this application is dismissed with direction to the court below to conduct the trial of the petitioner on day to day basis and conclude the same within a reasonable time even by separating his trial from other accused person. At the same time, S.P. Muzaffarpur, is also directed to ensure the production of witnesses in the trial court on the date fixed so that the trail be concluded expeditiously. Needless to say that the aforesaid direction must be complied in a strict sense.
