Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342,323, 324, 307 of the Indian Penal Code and later on Section 302 of the I.P.C. was added.

Petitioner is in custody since 17.05.2015. Allegation is that he had caused fatal injury to the deceased. In the past, thrice prayer for bail was refused vide order at Annexure-1 series. Every time giving direction to the learned trial court to conclude the trial within the time frame. Last order was passed on 18.01.2018 granting six months time to the learned trial court to conclude the same, however, the report of the learned Trial Judge dated 18.02.2019 reveals

Patna High Court CR. MISC. No.69947 of 2018(6) dt.11-04-2019 2/2 that the case is still at the stage of prosecution evidence. Petitioner is ready to cooperate with the trial. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.136 of 2016 arising out of Shankarpur Police Station Case No.64 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
