2. The petitioner, who is lady, apprehends her arrest in a case registered for the offence under Sections 318(4), 131 of the Bhartiya Nyaya Sanhita, 2023.
3. Allegation against petitioner is that she has cheated the complainant by way of registering wrong plot no. 404 instead of plot no. 403 and also received Rs. 10 Lakhs for the same.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. The
Patna High Court CR. MISC. No.46282 of 2026(2) dt.28-07-2026 2/3 petitioner has sole the same land to the informant, which had been purchased by her and no fraud has been committed by her. Petitioner had previously purchased the land from one Mukesh Kumar Singh, vide registered sale-deed no. 3132 dated 17.03.2021, and thereafter got the land mutated in her name and Jamabandi was also created in her name and since then, she is also paying rent. Learned counsel further submits that coaccused Shyam Shagal lodged a complaint, bearing Complaint Case No. 212 of 2026, against the previous land-owner, demonstrating the clerical error regarding plot number in the earlier deed, of which, petitioner was entirely unaware. Moreover, the dispute is purely of civil nature and no criminal offence is made out. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-I cum Addl. Civil Judge (Jr. Division), Danapur, Patna, in connection with Complaint Case No. 897C of 2024, subject to
Patna High Court CR. MISC. No.46282 of 2026(2) dt.28-07-2026 3/3 condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
