The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 448, 380, 504, 506 of the Indian Penal Code.
The prosecution case is that the dispute with regard to carrying animals through the land of the informant. The informant made protest, then accused persons assaulted the informant. When elder brother of the informant Dwarka Yadav came to rescue, then he was assaulted by Bhola Prasad and this petitioner with iron rod. It is further alleged that relatives of the accused persons also assaulted Akhilesh Kumar, Ashok Prasad and Kashi Yadav.
Patna High Court Cr.Misc. No.56772 of 2015 (2) dt.15-12-2015 It is submitted by the learned counsel for the petitioners that injury of the informant has been found to be simple in nature and there is counter version of the occurrence. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Similarly situated accused persons have been granted anticipatory bail vide Cr. Misc. No. 45823 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 56 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
