====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-03-2019 Heard learned counsels for the petitioner and the State.

Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 48490 of 2016, which was rejected vide order dated 16.01.2017 (Annexure-1).

This Court by its order dated 19.12.2018 had called for a report from the Court below regarding the present stage of the trial in the case, which has been received and is kept at Flag"A". Perusal of the report shows that the trial is in progress and only official witnesses have remained to be examined.

Learned counsel appearing for the petitioner submits that petitioner is languishing in custody since 09.06.2016. Except the statement of witnesses no material has

Patna High Court CR. MISC. No.72856 of 2018(4) dt.13-03-2019 2/2 come against this petitioner during investigation. Moreover, none of the witnesses has claimed to be eye witness to the alleged occurrence.

Considering the nature of allegations levelled and the present stage of trial, this Court is not inclined to grant bail to the petitioner. His prayer for bail is, therefore, rejected. However, the trial Court is directed to expedite the trial of the case and conclude it within six months from today. (Arvind Srivastava, J) mcv/- U T
