23-03-2021 Heard learned counsel for the parties.

This is 2nd attempt for grant of bail on behalf of petitioner in Uchkagaon P.S. Case No. 248 of 2018, registered for the offence under Section 302/34 of the I.P.C. Earlier, vide order dated 17.10.2019 passed in Cr.Misc. No. 22965 of 2019, the prayer for bail of petitioner was rejected. On last date i.e. on 08.02.2021, a report was called for from the Trial Court regarding stage of the trial, which has been received and kept at flag 'R'. From perusal of the same, it appears that out of five chargesheeted witnesses, four have already been examined, including informant, I.O. and doctor and only one witness is to be examined. Meaning thereby that trial is going on smoothly.

Patna High Court CR. MISC. No.40463 of 2020(3) dt.23-03-2021 2/2 Considering the aforesaid facts & circumstances and the stage of the trial, I am not inclined to grant bail to the petitioner and same is accordingly dismissed. However, the learned Trial Court is directed to conclude the trial as early as possible.
