The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 341, 323, 420, 467, 468, 406, 504/34 of the Indian Penal Code.
The prosecution case is that the complainant's land bearing plot no. 627 and 599 of khata no. 76 was sold by executing sale deed by co-accused Baliram Paswan in favour of Ram Prasad Singh, whereas the petitioner was deed writer.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.57931 of 2015 (2) dt.04-01-2016 petitioner that the thrust of accusation is against Baliram Paswan, who executed the sale deed. Though the petitioner is accused in one another case for similar nature in which he has been granted bail. Moreover, the purchaser Ram Prasad Singh has been granted anticipatory bail vide Cr. Misc. No. 52408 of 2015 by a Co-ordinate Bench of this Court.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Mahavir Prasad, J.M. Ist Class, Aurangabad in connection with Complaint Case No. 118 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
