This is a petition for grant of anticipatory bail for offences under Sections 402 and 399 of the Indian Penal Code and 3 and 4 of the Explosive Substances Act.

The police heard the sound of bomb blast and when reached near the place of occurrence, co-accused, Ravindra Paswan, who had sustained bomb injury, was arrested and he disclosed that he along with others, including the petitioner, was making preparation to commit dacoity and by chance one of the bombs blasted.

Submission of the petitioner is that the petitioner has got no criminal antecedent.

The learned counsel for the State submits that there is no criminal antecedent against the petitioner in the case diary. Considering the aforesaid fact that only material against the petitioner is confession of the co-accused, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of

Patna High Court Cr.Misc. No.55392 of 2016 (3) dt.10-02-2017 2/2 Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sadar P.S. Case No. 321 of 2002 to the satisfaction of the Additional Sessions Judge, I, Purnea, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
