JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Mahila P.S. Case No. 33 of 2016 registered under Sections 376 and 313/34 of the Indian Penal Code.
The accusation against the petitioners along with their sons is of sexually exploitation on the allurement of marriage to the victim with their son and later on, causing miscarriage by administering medicine.
Learned counsel appearing on behalf of the petitioners submits that petitioners, who happen to be mother-inlaw and father-in-law respectively, have falsely been implicated in this case. Further submission is that similarly situated co-accused
Patna High Court Cr.Misc. No.46843 of 2016 (3) dt.08-02-2017 2/2 namely Dharmendra Kumar has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 38833 of 2016 on 17.10.2016.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Gaya in connection with Mahila P.S. Case No. 33 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
