JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in Palanwa (Bhelahi O.P.) P.S. Case No.7 of 2015 registered for the offences under Sections 420, 467, 468, 471, 120(B)/34 of the I.P.C. Allegation of the informant is that co-accused Dhrup Shankar Sah and Rajesh Sah applied for krishi loan annexing the rent receipt issued for year 2014-15 with the application were forged as the same were not issued from the Circle Office, Raxaul.Further allegation is that co-accused Rajesh Sah in his confessional statement disclosed that this petitioner helped him in procuring the rent receipt.

Patna High Court Cr.Misc. No.43573 of 2016 (2) dt.05-10-2016 2/2 Learned counsel for the petitioner submits that the petitioner has got no criminal history and has falsely been implicated in this case.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Raxaul, East Champaran, at Motihari, in Palanwa (Bhelahi O.P.) P.S. Case No.7 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
