This application for grant of anticipatory bail arises out of Sakra P.S. Case No. 200 of 2016, corresponding to G.R. No. 3014 of 2016, disclosing offence under Sections 272 and 273 of the Indian Penal Code and Section 47(a)/57 of the Bihar Excise Amended Act.
From the house of the petitioner placed beneath a wooden bed (Chowki) huge quantity of foreign made liquour, was recovered.
Considering the fact that despite prohibition in the State of Bihar and stringent penal provisions, the petitioner is alleged to have engaged himself in such activity, I am not inclined
Patna High Court Cr.Misc. No.41077 of 2016 (2) dt.27-09-2016 2/2 to grant him the privilege of anticipatory bail. Accordingly, this application for anticipatory bail is, hereby, rejected.
The petitioner is directed to surrender before the court below within two weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
