1. Learned counsel for the petitioner does not appear.
2. However, learned counsel appearing for Rakesh Ranjan Singh in another case informs that the petitioner has already attained superannuation and has retired in May, 2015.
3. In the present petition, the writ petitioner has prayed to direct the respondent Board not to accept or recognize the claim of respondent no. 3 or any person to have authority to conduct examination.
4. It is noticed that in one writ petition filed by the same petitioner bearing C.W.J.C. No. 13544 of 2009, the
Patna High Court CWJC No.1566 of 2010(4) dt.26-07-2022 2/2 directions were issued to the Board to take a decision and thereafter in C.W.J.C. No. 15345 of 2007, vide order dated 23.12.2008, it was directed earlier by this Court to the University to take a decision with regard to the position of the Professor-in-charge of the College and it was decided by the Vice Chancellor vide order dated 04.02.2009 that the Professorin-charge of the College shall be respondent no. 3, who shall have the control of the Degree Section as well as over the Intermediate Section.
5. Keeping in view, the decision dated 04.02.2009, which is not under challenge in the writ petition, the prayer made by the petitioner cannot be accepted. Moreover, since he is retired, no orders are required to be passed on merits of the case.
