JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Qazi Mohamadpur P.S. Case No. 486 of 2014, registered under Sections 323, 341, 379, 385, 406 and 504/34 of the Indian Penal Code.
The accusation is that Md. Kaimuddin, father of the petitioners, took cash of Rs.5720/- from the pocket of the informant whereas both petitioners also snatched the gold chain and wrist watch from the informant.
Learned counsel for the petitioners submits that, in
Patna High Court Cr.Misc. No.2295 of 2017 (2) dt.06-02-2017 fact, petitioners are the relative of co-accused, Jafu Mian and Jafu Mian who were working as labourer in the Small Scale Industries of informant and some dispute arose between the informant and Jafu Mian due to that reason petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Qazi Mohamadpur P.S. Case No. 486 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
