Petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of Arms Act.

Accusation in the F.I.R. is that the petitioner and others indiscriminately fired at Wasi Ahmad as a result whereof he died. The petitioner is in custody since 02.05.2016. Earlier this Court had refused prayer for bail of the petitioner in Cr.Misc.No.8629 of 2017 on 10.04.2017 with direction to the learned trial Judge to expedite the trial and if the same is not concluded within six months, the petitioner will be at liberty to renew his prayer for bail before the learned trial Judge itself who

Patna High Court Cr.Misc. No.55126 of 2017 (3) dt.13-12-2017 2/2 shall pass a reasoned order.

The impugned order reveals that the charges have already been framed in the case and the trial is not proceeding in absence of the other accused persons.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-6th , Siwan, in Session Trial No.95 of 2017 arising out of Hussainganj P.S.Case No.14 of 2016 with condition that the petitioner shall fully cooperate with the trial and shall not remain absent on the date fixed in this case without reasonable excuse otherwise learned trial Judge would be at liberty to cancel his bail bond.
