The petitioner apprehends his arrest in Bhabhua P.S. Case No. 380/2016, registered for the offences punishable under Sections 406, 420 and other sections of the Indian Penal Code. The present case has been lodged against the petitioner and others on account that the petitioner did not submit the registers and folders of Panchayat Teachers appointment in different panchayat in the year 2003, 2005, 2006, 2008, 2012 and 2014-15.
Learned counsel for the petitioner submits that the petitioner joined on 19.05.2015 in Kaithi and Dihara panchayat. He did not receive any document from his predecessors and that is
Patna High Court Cr.Misc. No.41403 of 2016 (2) dt.22-11-2016 2/2 why the petitioner wrote letter to the Block Education Officer vide annexure-2, but even then the case has been lodged. Considering the facts aforesaid and the fact that the petitioner did not receive the document with regard to appointment of panchayat teachers of different years at the time of handing over charge from his predecessors and Panchayat Sachiv of gram panchayat Kaithi and Dihara, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S. Case No. 380/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
