2. The petitioners are apprehending their arrest in a case in connection with Sasaram Town P.S. Case No. 994 of 2023 dated 27.10.2023 registered for the offence/s punishable u/ss 147, 148, 149, 341, 323, 427, 379, 504, 506 and 354 of the Indian Penal Code and 27 of the Arms Act.
3. As per the prosecution case, the petitioners and the coaccused persons along with 40-50 unknown miscreants are alleged to have came to the door of the informant and started abusing and assaulting him and her wife with lathi, danda, sword and iron rod. They outraged the modesty of her wife and snatched golden chain and cash.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.47901 of 2024(2) dt.13-09-2024 2/2 case due to political rivalry. There is general and omnibus allegation against the petitioners. The petitioners are the members of the mob. Nothing has been recovered from the conscious possession of the petitioners. The co-accused persons have already been granted anticipatory bail by this court vide order dated 06.03.2024 passed in Cr. Misc. No. 8519 of 2024. The petitioner no. 1 has two criminal antecedents whereas the petitioner no. 2 has no criminal antecedent as stated at para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Sasaram, Rohtas in connection with Sasaram Town P.S. Case No. 994 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
