The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 24, 326, 307, 387 and 506/34 of the Indian Penal Code. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

The prosecution case is that in the background of land dispute hot exchange took place when the petitioner assaulted indiscriminately with 'farsa' (a sharp cutting weapon) to the informant causing four injuries.

It is submitted by learned counsel for the petitioner that the injuries have been found to be simple in nature. Moreover, the informant has retracted from initial version and has filed a

Patna High Court Cr.Misc. No.387 of 2016 (2) dt.07-01-2016 2/2 petition to that effect before the learned court below, the same has been brought on record as annexure-3 to the petition. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bodh Gaya P.S. Case No.172/2015, pending before the learned CJM, Gaya. With the above observation, this application is, accordingly, disposed off.
