The petitioner seeks bail in connection with Town P.S. Case No. 313 of 2020 registered for the offences punishable under Sections 386, 387, 120(B)/34 of the Indian Penal Code. The prosecution story as described in the F.I.R. in short is that the informant, Vaibhav Mishra has stated in his written information that while he was in jail custody in connection with Kazimohammadpur P.S. Case No.92 of 2020 in which Hemant Kumar was also in jail then Hemant Kumar, Mithlesh Singh and Jitendra thakur @ Golu Thakur made three calls on mobile phone of wife of informant to withdraw the case otherwise her entire family would be finished. The informant
Patna High Court CR. MISC. No.39707 of 2020(3) dt.09-03-2021 2/3 immediately informed the jail authority as well as the police administration regarding the above calls upon which Mithilesh Singh was shifted to Bhagalpur Central Jail. Hemant Kumar and Golu thakur became annoyed with the informant and they started torturing him mentally. Further allegation is that when the informant was in Motijheel, he received a call on his mobile whereby the caller gave threat to withdraw the case and to give rupees two lakhs for the expenses incurred on case or to face bad consequences.
Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated in the present case. He further submits that the informant is himself a veteran criminal and was also in jail and he is an accused of more than five cases and the petitioner was never given threats to the informant. Petitioner is in jail custody since 15.06.2020 and petitioner has six criminal antecedent mentioned in paragraph-3 of the bail petition.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the
