JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 447, 338, 302, 504, 506 of the Indian Penal Code and 27 of Arms Act as well as Section 3 and 4 of Explosive Substances Act.

According to FIR, the petitioner hurled bomb causing death of the father of the informant. Other witnesses have also supported the allegation. Medical report is consistent with the prosecution allegation. Petitioner is in custody since 26.04.2017.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the

Patna High Court Cr.Misc. No.55475 of 2017 (6) dt.27-03-2018 present in connection with Banka Police Station Case No. 972 of 2016 pending in the court of learned Chief Judicial Magistrate, Banka /successor court.

Hence, prayer for bail is refused.

The learned trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order without allowing any unnecessary adjournments to any of the parties, failing which the petitioner would be at liberty to renew his prayer for bail before the learned trial court itself.
