Mr.Kalyan Shankar ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence under Sections 147, 148, 149, 341, 323, 307, 324, 353,337,338,332,333,504 of the Indian Penal Code and 30(a), 45 of the Bihar Prohibition and Excise Act, 2016 and Section 27 of the Arms Act.

Allegation is that illicit liquor was recovered by the police from the village of the petitioner. The petitioner and others obstructed in discharge the official duties by the police. Submission is that similarly situated co-accused have been granted bail by coordinate Bench of this Court vide Annexure- 2,3 and 4.

Considering the aforesaid fact, let the petitioner,

Patna High Court CR. MISC. No.41490 of 2019(2) dt.05-07-2019 2/2 above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Pipra P.S. Case No.71 of 2017 vide Special Case No. 7565 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
