Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 302, 120(B) of the IPC.
For property dispute, the petitioner allegedly committed murder of his wife as well as one of the step-child. Wife was mother of the informant and the deceased as well as she was mother of some children from the petitioner. Submission is that in fact the informant is not an eye witness of the occurrence and false implication is there due to property dispute. Petitioner is in custody since 21.01.2019. The trial has not been committed to the court of sessions as yet. Learned counsel for the informant opposed the prayer
Patna High Court CR. MISC. No.2599 of 2021(10) dt.21-10-2021 2/2 for bail on the ground that a case under Section 498A IPC was also there between the petitioner and the deceased. Moreover, this is a case of double murder and the informant claims to be eye witness of atleast one of the murder.
Considering the period already undergone by the petitioner and no chance of early hearing of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulwarisarif Police Station Case No.916 of 2018 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
