JUSTICE SANJAY PRIYA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 377, 511 of the Indian Penal Code and Section 8 of the POCSO Act.

It is alleged in the written report submitted by one Suraj Kumar that on 16.11.2015 the petitioner on assurance to give him job, started kissing him and tried to insert finger in his private part and when the informant protested, he committed unnatural offence with him. On alarm raised by the informant, the petitioner went to his Apartment. It is alleged that the petitioner earlier also committed unnatural offence with 2 to 3 boys namely, Deepak Kumar, Golu Kumar and Tinku Kumar. The case diary has been received. Patna High Court Cr.Misc. No.40920 of 2016 (3) dt.12-01-2017 2/2 witnesses in paragraphs 9, 10 and 11 have supported the allegation against the petitioner.

In such circumstances, there is serious allegation against the petitioner of committing unnatural offence with the informant which also gets support from the statement of the witnesses in the case diary. Therefore, I am not inclined to grant bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.
