JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-08-2019 The petitioner seeks quashing of the FIR in connection with Bhagwanpur Hat P.S. Case No. 30 of 2018 dated 11.02.2018 instituted under Sections 272, 273, 308 and 420 of the Indian Penal Code and Sections 30(a), 41(i) of the Bihar Prohibition and Excise (Amendment Act) 2016.

The only ground which has been urged for quashing the FIR with respect to the petitioner is that the name of the petitioner has transpired in the confession of two of the arrested accused persons. This can be a good ground for grant bail but not for quashing

Patna High Court CR. MISC. No.43447 of 2019(2) dt.20-08-2019 2/2 of the FIR. Investigation in this case is required to be made and without that, it cannot ever be known as to who had asked for such huge consignment of liquor. There is no merit in this petition and the same is dismissed.
