The petitioner apprehends his arrest in Barari P.S. Case No. 170 of 2015 registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code. The informant alleged that his wife woke up in the night and saw his daughter Rehana Khatoon missing from her bed. During course of search, the informant came to know that Jwala Kumar with the help of Manjar and the petitioner Raman Sharma @ Ramana enticed his minor daughter.

Learned counsel for the petitioner submits that the victim was not minor. The victim was earlier married twice but she was divorced by her former husbands. The petitioner is a married man, he got three sons and he has got no manner of

Patna High Court Cr.Misc. No.41320 of 2016 (4) dt.01-12-2016 2/2 concern. The informant is not an eye witness of the occurrence and nobody has seen the petitioner taking away the daughter of the informant.

Considering the facts aforesaid and the facts that none of the witness has seen the occurrence and only suspicion is raised against the petitioner that he helped Jawala Kumar, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Barari P.S. Case No. 170 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.) KKSINHA/- U T
