2. The petitioners apprehend arrest in connection with Janta Bazar P.S. Case No. 19 of 2025 dated 25.01.2025, registered for the offence punishable under Sections 127(1), 126(2), 115(2), 118(2), 117(2), 303(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nayay Sanhita, 2023.
3. The allegation against the petitioners, is that they assaulted Bhagwan Raut, Fuleshwar Raut, Bhagmani Devi, Lagan Devi, Srimati Devi, Umrawati Devi and Sunil Raut with
Patna High Court CR. MISC. No.45564 of 2025(3) dt.17-10-2025 2/3 sabal, bricks and stone due to which they became injured.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that there is case and counter case between the parties. It is submitted that mother of the petitioners, namely, Lalmati Devi has lodged the F.I.R. against the informant and others on the same day bearing Janta Bazar P.S. Case No. 20 of 2025 for the offence punishable under Section 109 and allied sections of B.N.S.. It is also submitted that due to pity issue, the occurrence took place. The injury report shows that the doctor has found the injuries over the nose of Fuleshwar Raut and Bhagwan Raut which are grievous in nature and injuries of other injured persons are simple in nature. Lastly, it has been submitted that they have no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Janta Bazar P.S. Case No. 19 of 2025, they shall be released on anticipatory bail
