Petitioner, husband of opposite party no.2, apprehends his arrest in a case registered for offence punishable under section 498A of the Indian Penal Code on the allegation that soon after marriage, he started subjecting his wife (opposite party no.2) to cruelty for bringing dowry if she desires to live at her matrimonial house.
Learned counsel for the petitioner undertakes that the petitioner would go to the parental house of opposite party no.2 and bring opposite party no.2 to her matrimonial house within a week of pronouncement of this order, thereafter he would keep her with care and honour without any dowry demand. Learned counsel appearing for the opposite party no.2 agrees that opposite party no.2 will go with the petitioner. Let the petitioner, as mentioned above, be released on bail, in the event of his surrender within six weeks, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial

No.41267 of 2019(3) dt.16-11-2019 2/2 Magistrate, Patna in connection with Complaint Case No. 2140C of 2018 on the following condition:- As per the undertaking given by learned counsel for the petitioner, the petitioner would go to the parental house of his wife (opposite party no.2) and bring her to his house within a week of pronouncement of this order, and would keep her with care and honour without any dowry demand.
In case of breach of undertaking given by the petitioner, opposite party no.2 would be at liberty to move before the court below, which would pass appropriate order in the matter.
