JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail, the petitioner apprehends his arrest for the offence punishable under Section 409 of the Indian Penal Code.

Allegedly, co-accused Prashant Kumar, the Junior Accountant had not produced relevant documents for inspection which raised suspicion in the mind of informant that there is financial irregularity. During course of investigation, the name of the petitioner also transpires.

Submission is of false implication and that co-accused Prashant Kumar has already been allowed pre-arrest

Patna High Court Cr.Misc. No.51484 of 2016 (2) dt.19-12-2016 2/2 bail by a co-ordinate Bench of this Court vide Cr. Misc. no. 30742 of 2016 dated 18.10.2016 as Prashant Kumar had produced all the papers to the authorities on 03.10.2016, the petitioner at the relevant time was Divisional Accounts Officer and in the First Information Report, there is no allegation against the petitioner. In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender before the Court below within four weeks from the date of receipt/ production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Begusarai (Lohiyanagar O.P.) P.S. case no. 242 of 2016 subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
