The petitioner seeks bail in Tilauthu P. S. Case No. 27 of 2018 instituted for the offence under Section(s) 302 and 120B/ 34 of the Indian Penal Code.

In the written report, it is alleged that husband of the informant was surrounded by this petitioner and three other accused persons as named in the written report near the bus stand, Lewra towards west of village- Tilauthu, Sasaram Pakki road. He was injured by firearm. The informant has alleged that this petitioner along with Krishna Mahto, Sudama Mahto and Shambhu Mahto has caused firearm injury.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.59722 of 2018(3) dt.29-10-2018 2/2 the statement of the informant is available in Para 68 of the case diary, wherein, she has not taken the name of this petitioner. The informant in her statement recorded under Section 164 Cr.P.C. has not taken the name of any of the accused persons. It has further been submitted that daughter and brother of the deceased have given their statement in Para 7 and 9 of the case diary, wherein, they have not taken the name of this petitioner. Petitioner is in custody since 30.07.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Dehiri, Rohtas, in connection with Tilauthu P. S. Case No. 27 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
