JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 18-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 79 of 2021 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise, Act.

Learned counsel for the petitioner submits that the recovery has been made from the house of Fekan Singh, which is far from him and the petitioner has been made an accused on the basis of suspicion.

Taking into consideration the fact that the liquor was recovered from the house of Fekan Singh and the petitioner cannot be said to be connected with the same, prima facie case under Section 30(a) of the Act is not made out, I am inclined to
