JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 342, 386, 307, 420, 406, 34 of the Indian Penal Code. The prosecution case is that the petitioner along with co-accused Shankar Sao and the complainant entered into an agreement to purchase a particular piece of land to which the complainant had twenty percent of share, whereas the petitioner and co-accused Shankar Sao each had forty percent share. Consequently the complainant paid Rs. 1,84,000/- as twenty percent of his share, but neither possession of the land in question was made to the complainant nor the invested amount has been returned. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the accusation being levelled in the background of share dispute, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Mufassil P.S. Case No. 14 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
