Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that petitioner No.1, Anoj Singh was apprehended along with liquor. Petitioner No.2, Manoj Singh was not there. However, in the disclosure statement of Anoj Singh, the name of Manoj Singh surfaced. Manoj Singh is full brother of Anoj Singh. Both petitioners have got identical criminal antecedents.

Considering the facts aforesaid, let petitioner No.1, Anoj Singh be released on bail, if the trial is not concluded

Patna High Court CR. MISC. No.40545 of 2019(2) dt.02-07-2019 2/2 within six months from the date of framing of the charges, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Parbatta Police Station Case No.134 of 2019, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Petitioner No.2, Manoj Singh, who is in custody since 14.05.2019, be released on bail at once on furnishing bail bond of Rs.

20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Parbatta Police Station Case No.134 of 2019, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
