Petitioner seeks bail in a case registered for the offences punishable under Sections 341,504,326,302/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation of commission of firearm injury and death is against co-accused-Lachhu Paswan. Petitioner is named in the FIR, however, he has got no criminal antecedent. He is in custody since 09.07.2018.
The report of the learned Trial Judge would reveal that charges have already been framed in this case on 31.08.2018, however no prosecution witness has been examined till date of report dated 06.02.2019.
Hence, let the petitioner, above named, be
Patna High Court CR. MISC. No.60968 of 2018(6) dt.09-04-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jamhor Police Station Case No.73 of 2006, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
