The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 504, 353/34 of the Indian Penal Code. The prosecution case is that Santosh Kumar, Marketing Officer, Town Area, Muzaffarpur went to verify the stock of sealed godown of the petitioner, when the mob made protest and assaulted the officials and confined them. On information S.P. and S.H.O. reached on the place of occurrence and got them released.

It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the petitioner participated in the occurrence. For the occurrence of 08.09.2015 the First Information Report was registered on

Patna High Court Cr.Misc. No.56102 of 2015 (2) dt.10-12-2015 10.09.2015. Moreover the seized rice have been released in favour of the petitioner in pursuance of the order passed in C.W.J.C. No. 17709 of 2015.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Nagar (Town) P.S. Case No. 704 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
