After some argument, learned counsel for the petitioner seeks permission to withdraw this application to facilitate petitioner Md. Shakil @ Md. Shakil Ansari to surrender and pray for regular bail.

Accordingly, this applications stands dismissed as withdrawn.

Patna High Court CR. MISC. No.9588 of 2021(2) dt.28-07-2021 2/2 It would be evident from order dated 02.07.2020 passed in Cr. Misc. No. 3700 of 2020 that it was submitted on behalf of petitioner Md. Shakil @ Md. Shakil Ansari that he has already been arrested. Hence his prayer for anticipatory bail was infructuous. Now it has been informed that, in fact, he was not arrested rather due to fracture of leg, he could not surrender. There is no reason to modify the said order for simple reason that wrong statement was made before the court of law. If Md. Shakil will not surrender within 10 days, the court below shall take coercive step for his apprehension. (Birendra Kumar, J) mantreshwar/- U T
