The petitioner seeks bail in Phenhara P.S. Case No. 15 of 2016 registered under Sections 386, 387 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Two motorcycle borne criminals arriving at the construction site of Shreepee Builder India Pvt. Ltd. at Krisnanagar Phenhara path resorted firing over not obliging by its Munshi their extortion demand. One of them was identified as Ravi Singh.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any
Patna High Court Cr.Misc. No.54531 of 2017 (2) dt.14-12-2017 2/2 incriminating article has been recovered from his conscious physical possession. He has neither made any demand nor resorted firing over the same. His name has surfaced in the occurrence in his confessional statement recorded by the police in some other case which has no evidentiary value in the eye of law. Barring the said confessional statement, there is no cogent material indicating the complicity of the petitioner in the occurrence. The petitioner has been languishing in custody since 10.03.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 12th, Motihari, East Champaran in connection with Phenhara P.S. Case No. 15 of 2016.
